Client Agreement and Terms of Service

Part 1 — General terms

1.1 Parties

These terms govern the contract between Saretta Müller, trading as GOOD — Nutrition & Pilates by Sasha, An der Goldgrube 38, 55131 Mainz, Germany ("GOOD", "we", "I") and the person booking a service ("you", "the Client"). They form part of every booking made through goodnp.de or any booking system we operate.

1.2 What we offer

  1. Reformer Pilates — group, duo and private movement instruction on Reformer and mat, delivered in person or online.

  2. Nutrition coaching — individual and group coaching on food, eating patterns and daily habits, including the interpretation of results from third-party laboratory tests you choose to take.

  3. Workshops, classes and digital products — group formats and downloadable frameworks and guides.

1.3 What we are not

GOOD is a preventive health, movement and education service. It is not medical care.

  • We do not diagnose, treat, cure, alleviate or monitor any illness, condition, injury or disorder.

  • We do not practise Heilkunde within the meaning of § 1 Heilpraktikergesetz, and hold no Heilpraktiker licence. We are not physicians, physiotherapists, Diätassistenten, psychotherapists or pharmacists.

  • Nothing we provide replaces advice, diagnosis, treatment or medication from a qualified medical professional. Never stop, start or change prescribed medication or medical treatment on the basis of anything discussed with us.

  • If you are under medical care for any condition, discuss your participation with your treating doctor before you begin, and keep them informed.

  • We give no guarantee of any specific outcome — physical, aesthetic, metabolic or otherwise.

1.4 Your responsibilities

The work depends on what you bring to it. You agree that:

  1. Your physical, mental and emotional wellbeing remains your own responsibility, as do your choices, decisions and actions.

  2. You will answer the health screening questions fully and truthfully before your first session, and tell us without delay if anything changes — a new injury, a new diagnosis, a new medication, a pregnancy, or a new eating-related difficulty.

  3. You will tell us if you are under the care of a physician, physiotherapist, psychotherapist or other health professional in a way that bears on the work.

  4. You will stop immediately and tell us if you feel pain, dizziness, breathlessness or anything else that alarms you during a session.

  5. You will communicate openly and give direct feedback. Coaching works on honesty.

1.5 Formation of the contract

The contract comes into effect when you complete the online intake form, tick the required boxes and submit your booking, and we confirm it by email. We will send you these terms in full with that confirmation.

1.6 Age

Clients must be 18 or over. Under-18s may participate only with the written consent of a parent or legal guardian, who accepts these terms on their behalf.

1.7 Attendance and conduct

Sessions start at the time booked. Arriving more than ten minutes late to a Reformer session means we may decline entry on safety grounds, and the session is treated as taken. We may end a session or the whole engagement without refund where a client is abusive, harasses another client or instructor, attends under the influence of alcohol or drugs, or repeatedly ignores safety instructions.

Part 2 — Reformer Pilates

Applies where you book Pilates instruction, in person or online.

2.1 Qualification and scope

Pilates instruction at GOOD is delivered by an instructor holding the Balance Advanced Reformer Pilates certification. Pilates instruction is movement education, not physiotherapy and not rehabilitation. We do not assess injuries, prescribe therapeutic exercise for a diagnosed condition, or perform manual therapy. Where you are under the care of a physiotherapist or doctor, we will work within limits they set, but we do not set those limits ourselves.

2.2 Assumption of risk

Pilates is physical exercise using spring-loaded equipment. Even with correct instruction it carries a risk of muscle soreness, strain, sprain, fall, and in rare cases more serious injury, and it may aggravate an existing condition. You confirm that you take part voluntarily, in the knowledge of these risks, and that you believe yourself fit to do so.

2.3 Health screening and contraindications

You must complete the health screening before your first session. You must obtain medical clearance from your doctor before attending if any of the following applies to you:

  • a heart condition, chest pain, or uncontrolled high blood pressure

  • recent surgery, or a fracture or acute injury still healing

  • a diagnosed spinal condition, including disc herniation, spondylolisthesis or severe osteoporosis

  • a joint replacement within the last twelve months

  • epilepsy, or fainting or dizzy spells

  • any condition your doctor has told you should limit physical exercise

We may decline to teach you, or may modify or stop an exercise, where in our judgement it is not safe. That judgement is final and is made in your interest.

2.4 Pregnancy and post-natal

Tell us as soon as you know you are pregnant. Pregnancy does not exclude you, but it changes what we teach and requires your midwife's or doctor's clearance. After birth, we ask for clearance following your post-natal check, and for a diastasis recti assessment before any abdominal loading.

2.5 In the studio

  • Grip socks are required on the Reformer. Long hair tied back; no rings, watches or loose jewellery that can catch in the springs or straps.

  • Follow set-up instructions on spring settings, footbar and straps exactly. Do not adjust equipment or use it unsupervised.

  • Report any equipment fault immediately and stop using it.

  • Personal belongings are brought at your own risk. We are not liable for loss or damage to property except where clause 5.1 provides otherwise.

2.6 Online sessions

For sessions delivered online, you are responsible for your own training space: adequate clear floor area, a stable surface, no trip hazards, and equipment that is sound and correctly set up. Our view of you through a camera is limited, and we may not be able to see or correct unsafe positioning. If you cannot be seen clearly for the whole session, we may ask you to reposition or may end the session.

Part 3 — Nutrition coaching

Applies where you book nutrition coaching, a consultation package or a test review.

3.1 Qualification and scope

Nutrition coaching at GOOD is delivered by an IPHM-accredited nutrition coach (FDN-trained; Stanford School of Medicine child nutrition course). These are coaching and education qualifications. They are not a German state-recognised health profession: we are not Diätassistentin, Ernährungsmedizinerin or Heilpraktikerin.

Our work is preventive and educational. It concerns food, eating patterns, meal structure, shopping, cooking, sleep and daily rhythm in people who consider themselves well.

3.2 The legal boundary, stated clearly

Under § 1 Heilpraktikergesetz, only physicians and licensed Heilpraktiker may practise Heilkunde — any professional activity aimed at establishing, curing or alleviating illness, suffering or bodily harm. GOOD does not do this, and you should not expect it to.

In practice this means:

  • We do not diagnose, and nothing we say is a diagnosis.

  • We do not treat disease, and we do not design plans to treat a diagnosed condition.

  • We do not tell you to start, stop or change any medication, and we will not comment on whether a prescribed treatment is right for you.

  • Where what you describe sounds like it needs medical assessment, we will say so and refer you to a doctor. We may decline or pause the engagement on that basis.

  • If you are under active medical treatment, we work alongside your doctor, not instead of them, and we will ask you to tell them what we are doing.

3.3 Laboratory testing

Where your programme includes testing, the tests are supplied and analysed by independent third-party laboratories (for example myBioma, ORY Analysis, mybody-x). You contract with the laboratory for the test; GOOD is not the provider of the test and does not perform the analysis.

  • Test results are educational information about your current biology. They are not medical diagnostics and are not a substitute for clinical investigation by a doctor.

  • We read results to inform food and lifestyle coaching only. We do not interpret them as evidence of disease.

  • Results that look clinically significant will be referred to your doctor. Take the report to them.

  • Testing is optional. Declining a test does not exclude you from coaching.

3.4 Food first, and supplements

GOOD works through food, not supplementation. Where a supplement is mentioned, it is general information about a category, not a prescription and not a dosing instruction for you. Supplements can interact with medication and with each other. Check anything you intend to take with your doctor or pharmacist, particularly if you are pregnant, breastfeeding, or taking prescription medication.

3.5 Claims and information quality

We describe food and nutrients in line with EU law. Under Regulation (EC) No 1924/2006, only health claims authorised on the EU Register may be made about foods, and claims that a food prevents, treats or cures disease are prohibited (Art. 7 Regulation (EU) No 1169/2011). Where our materials describe an effect, they do so within those limits. Language elsewhere — online, in books, from other practitioners — often does not.

3.6 Disordered eating

GOOD is not equipped to support eating disorders and does not work with clients in active treatment for one. If disordered eating is present or emerges, we will end or pause the nutrition engagement and refer you to appropriate specialist care. This is a limit of competence, and it protects you.

Part 4 — Fees, cancellation and right of withdrawal

4.1 Prices and payment

Prices are those shown at the time of booking and are payable in advance unless agreed otherwise. As a small business under § 19 UStG, no VAT is shown or charged.

4.2 Cancelling or moving a session

Notice given

Outcome

48 hours or more before the booking

       Full refund, or rescheduled

Less than 48 hours

No refund. You may transfer your place to another person

No-show

       No refund

A session we cancel is rescheduled or refunded at your choice.

Where illness or a genuine emergency prevents late notice, tell us

we will not apply this rigidly.

4.3 Packages and class cards

Multi-session packages are valid for twelve months from purchase. Unused sessions expire at the end of that period. We will extend validity on request where illness, injury, pregnancy or a move prevented use. Packages are personal and non-transferable unless we agree otherwise in writing.

4.4 Ongoing coaching programmes

Where you book a coaching programme of a fixed number of sessions over a fixed term, the term and session count are those stated at booking. Either party may end the programme for good cause (wichtiger Grund, § 626 BGB) at any time. Sessions already delivered are payable; sessions not yet delivered are refunded.

4.5 Right of withdrawal

Withdrawal instruction

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days from the day the contract was concluded.

To exercise it, you must inform us — Saretta Müller, GOOD — Nutrition & Pilates by Sasha, An der Goldgrube 38, 55131 Mainz, sasha@goodnp.de, +49 176 803 79071 — by a clear statement (for example a letter sent by post or an email). You may use the model withdrawal form, but it is not obligatory. You may also use the withdrawal function on our website. To meet the deadline it is sufficient that you send your communication before the period expires.

Effects of withdrawal. If you withdraw, we will reimburse all payments received from you without undue delay and in any event no later than fourteen days from the day we are informed. We will use the same means of payment you used, unless you expressly agree otherwise; you will not incur any fees as a result.

If you requested that services begin during the withdrawal period, you must pay us an amount proportionate to what has been provided up to the point you inform us of your withdrawal, in comparison with the full scope of the contract.

4.6 Starting before the withdrawal period ends

If your first session falls within fourteen days of booking, we cannot begin without your express request. At booking you may consent to us starting early. Where you do, and we have fully performed the service, your right of withdrawal expires on completion (§ 356 Abs. 5 BGB). Where we have only partly performed, your right of withdrawal continues and clause 4.5 applies.

If you do not consent to an early start, the earliest session we can offer is fifteen days after booking.

4.7 Digital products

Downloadable guides and frameworks are supplied immediately on purchase. Your right of withdrawal expires once download begins, where you expressly consented to that and acknowledged the loss of the right (§ 356 Abs. 6 BGB). This is confirmed by a separate tick-box at checkout.

Part 5 — Liability

5.1 What we are liable for

We are liable without limitation for damage arising from injury to life, body or health caused by a breach of duty by us or our agents, and for any other damage caused by intent or gross negligence.

For slight negligence, we are liable only where a material contractual obligation is breached — an obligation whose fulfilment makes proper performance of the contract possible in the first place, and on whose fulfilment you may regularly rely. In that case liability is limited to foreseeable damage typical of this type of contract.

Liability under the Produkthaftungsgesetz is unaffected.

5.2 What we are not liable for

Any further liability is excluded. In particular we are not liable for:

  • outcomes you hoped for and did not achieve, where we performed the service properly

  • consequences of information you withheld or gave inaccurately in the health screening

  • the accuracy or clinical significance of results produced by third-party laboratories

  • decisions you take about medication, medical treatment or supplementation

  • loss of or damage to personal property brought to a session, save under clause 5.1

5.3 Insurance

We carry professional liability insurance covering both Pilates instruction and nutrition coaching. Details on request.

5.4 Force majeure

Where we cannot deliver a session for reasons outside our reasonable control — illness, studio closure, an official order, a failure of the power or internet supply — we will offer a replacement date or a refund of the proportionate amount. Neither party is otherwise in breach.

Part 6 — Data protection

Controller: Saretta Müller, GOOD — Nutrition & Pilates by Sasha, An der Goldgrube 38, 55131 Mainz. Contact: sasha@goodnp.de.

6.1 Health data needs separate consent

Almost everything you tell us in the health screening — injuries, conditions, pregnancy, medication, test results — is special category data under Art. 9 GDPR. We may process it only with your explicit consent, given separately from your agreement to these terms. That is why it has its own tick-box.

You may withdraw that consent at any time with effect for the future. Withdrawal does not affect processing already carried out. If you withdraw it, we cannot continue to teach or coach you safely, and the engagement ends.

6.2 What we process and why

Data Purpose Legal basis
Name, email, phone, address Booking, contact, invoicing Art. 6(1)(b) — contract
Payment details Processing payment Art. 6(1)(b) — contract
Health screening answers, session notes Safe instruction; coaching Art. 9(2)(a) — explicit consent
Laboratory test results Coaching interpretation Art. 9(2)(a) — explicit consent
Invoices and tax records Statutory retention Art. 6(1)(c) — legal obligation
Email address for the newsletter Marketing Art. 6(1)(a) — consent

6.3 Who else sees it

We use service providers who process data on our behalf under Art. 28 GDPR contracts: our website and booking platform, our email provider, our payment provider, and our accountant. Where you order a laboratory test, you contract with that laboratory directly and they are a separate controller for the sample and its analysis

their privacy notice applies to that part.

We do not sell your data and do not share it with anyone else without your consent, unless we are legally required to.

6.4 How long we keep it

Health screening answers and session notes are kept for the duration of the engagement and for three years after your last session, then deleted. Invoices and booking records are kept for eight years under § 147 AO and § 257 HGB. Newsletter data is kept until you unsubscribe.

6.5 Your rights

You have the right to access your data, to have it corrected, to have it erased, to restrict its processing, to receive it in a portable format, and to object to processing based on legitimate interests. Write to sasha@goodnp.de and we will respond within one month.

You may also complain to the supervisory authority: Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz, Hintere Bleiche 34, 55116 Mainz.

6.6 Photographs, video and testimonials

We do not photograph or film you without your consent. Any consent you give is specific to a named use, is optional, is never a condition of taking part, and can be withdrawn at any time. Testimonials are published only with your consent and only as you approved them.

We do not publish before-and-after body images. German advertising law restricts them, and they do not reflect how we work.

Part 7 : Confidentiality, law and disputes

7.1 Confidentiality

Everything you share with us is treated as confidential and is not disclosed without your written consent. Your name is not used as a reference without your permission.

This is a contractual duty, not legal privilege. It does not apply to information already publicly known, information we held before you shared it, information we receive lawfully from a third party, or disclosure required by law or a court.

7.2 Governing law and jurisdiction

This contract is governed by German law. Where you are a consumer resident in another EU or EEA state, the mandatory consumer protection rules of your country of residence continue to apply.

7.3 Disputes

Talk to us first: most things are resolved in a conversation. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not currently do so.

7.4 Severability

If a provision is or becomes invalid, the remainder stands. The invalid provision is replaced by the statutory rule.

7.5 Changes

We may update these terms for future bookings. The version in force at the time of your booking governs that booking. Material changes affecting an ongoing programme require your agreement.

7.6 Language

These terms are provided in English and German. The German version is the legally authoritative text; this English version is a translation for information. In the event of conflict, the German version prevails.
